Any user shall not list or post any information consisting of materials with an expression which is prohibited by law of the land in any manner.   

DISCLAIMER OF WARRANTIES AND INDEMINITY

The user of EumaxIndia.com is at his / her / their own risk while using the site.   This website provided by EumaxIndia.com is on an “as is” and “as available” basis. EumaxIndia.com disclaims all warranties expressed or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose and non-infringement.

The user shall acknowledge that any warranty that is provided in connection with the products or services made available on or through EumaxIndia.com, is provided solely by the user, advertiser or manufacturer of that product and/or service and not by EumaxIndia.com.

EumaxIndia.com makes no representation of any kind, expressed or implied, as to the operation of the website or the known contents and the products on the website.

FEES

EumaxIndia.com reserves its right to impose any fee for any membership / usage by anyone at any future point of time.  In such an event, the member / user shall be liable to pay such fees as prescribed, failing which, EumaxIndia.com will be entitled to temporarily suspend or permanently discontinue the usage / membership from the website.  In no event, the fee paid shall be refunded. If you choose to terminate your membership, the membership fees are not refundable under any circumstances.


GOVERNING LAW AND JURISDICTION OF COURTS

EumaxIndia.com will be governed by the laws of India.  The courts at Chennai alone will have jurisdiction for all the matters that may arise out of the use of this website or out of any transactions with this website and no other court will have jurisdiction.

ARBITRATION

Any or controversy / dispute / difference / claim / claim in tort that may arise out of this Agreement or between any one of the user / advertiser and EumaxIndia.com, including its existence, validity or termination, during its existence or thereafter, shall be referred to and finally resolved by arbitration of sole / three Arbitrator(s) nominated by the Council for National and International Commercial Arbitration (CNICA),  at Old No.73, New No.90, Orient Chambers, 4th floor, Armenian Street, Chennai 600 001 and its rules shall prevail.  The Award so rendered shall be final and binding on the parties.  The language shall be English and the venue of the arbitration shall be within the city of Chennai.  

By placing an Order with EumaxIndia.com, I / we expressly agree that I / we have fully read and clearly understood all the aforesaid terms of this Agreement.  I / we expressly agree that we accept and undertake to strictly abide by the aforesaid clauses.  I / we declare that I / we have the power, authority and legal right to enter into this Agreement and represent on behalf of our company.
